By accessing or using Tipu by 4E's™, you agree to these Terms of Use. If you use Tipu by 4E's™ on behalf of an organisation, school, centre, or other entity, you confirm that you have authority to bind that entity to these Terms of Use.
You must only use Tipu by 4E's™ for lawful, authorised purposes and in accordance with your role, permissions, and any applicable policies. You are responsible for ensuring that information submitted through Tipu by 4E's™, including personal information, has been collected, used, and disclosed lawfully and with any required notices, permissions, or consents.
You are responsible for keeping your login details secure and for activities carried out under your account, except to the extent caused by Tipu by 4E's™. Tipu by 4E's™ may require security measures such as role-based access, Microsoft single sign-on (SSO), passkeys, or multi-factor authentication (MFA), particularly for personal logins, administrator accounts, or higher-risk access.
All intellectual property rights in Tipu by 4E's™, including its software, design, content, platform functionality, and related materials, are owned by or licensed to Tipu by 4E's™. You may not copy, modify, distribute, reverse engineer, decompile, or otherwise use any part of Tipu by 4E's™ except as permitted by law or with Tipu by 4E's™’s prior written consent.
Tipu by 4E's™ may update, suspend, or change any part of the platform from time to time. To the maximum extent permitted by law, Tipu by 4E's™ provides the platform on an “as is” and “as available” basis and does not guarantee uninterrupted, error-free, or completely secure operation. These Terms of Use are governed by the laws of New Zealand.
These Terms of Use govern access to and use of the Tipu by 4E's™ platform and any related services, applications, content, and functionality provided by Tipu by 4E's™. By accessing or using Tipu by 4E's™, you agree to be bound by these Terms of Use. If you do not agree, you must not access or use Tipu by 4E's™.
These Terms of Use apply to all users of Tipu by 4E's™, including organisations, administrators, employees, contractors, educators, caregivers, parents, guardians, and other authorised users. If you access or use Tipu by 4E's™ on behalf of an organisation, school, centre, or other entity, you represent and warrant that you have authority to bind that entity to these Terms of Use.
By accessing or using Tipu by 4E's™, you confirm that you are authorised to provide, upload, access, and manage the information entered into the platform, and that any personal information submitted through Tipu by 4E's™ has been collected, used, and disclosed in accordance with applicable law and any required notices, consents, or authorisations. Where you act on behalf of an organisation, school, centre, or other entity, you confirm that you have authority to bind that entity to these Terms of Use.
Tipu by 4E's™ grants you a limited, non-exclusive, non-transferable, revocable right to access and use the platform for lawful business, educational, administrative, and communication purposes in accordance with these Terms of Use. You must not use Tipu by 4E's™ for any unlawful, misleading, harmful, infringing, or unauthorised purpose.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account, except to the extent caused by Tipu by 4E's™. Tipu by 4E's™ may implement and require access controls and authentication measures, including role-based permissions, single sign-on (SSO), including Microsoft SSO where enabled, and passkeys, multi-factor authentication (MFA), or other identity verification measures where required for personal logins, administrator accounts, or higher-risk access scenarios. You must promptly notify Tipu by 4E's™ of any suspected unauthorised access, credential compromise, or misuse of your account.

You retain ownership of information, records, documents, and other content uploaded or submitted by you to Tipu by 4E's™. By submitting content to Tipu by 4E's™, you grant Tipu by 4E's™ a non-exclusive, worldwide, royalty-free licence to host, store, back up, reproduce, transmit, display, process, adapt, and otherwise use that content to the extent reasonably necessary to provide, maintain, support, secure, and improve Tipu by 4E's™ and to comply with legal obligations.
Tipu by 4E's™ is committed to the careful stewardship of personal information and to maintaining privacy and security settings that support lawful, fair, and responsible information handling. Tipu by 4E's™ maintains reasonable technical, administrative, and organisational safeguards to protect personal information and platform data against loss, and against unauthorised access, use, modification, disclosure, or misuse, including access controls, role-based permissions, logging and monitoring, and authentication measures such as SSO, including Microsoft SSO where enabled, and passkeys, MFA, or other identity verification measures where required for personal logins or higher-risk access. However, no cloud-based platform, hosting environment, or method of electronic transmission or storage can be guaranteed to be completely secure, and Tipu by 4E's™ does not warrant absolute security.
Tipu by 4E's™ may interoperate with or rely on third-party services, infrastructure, authentication providers, hosting providers, or integrations, including Microsoft and other identity or cloud providers. Tipu by 4E's™ is not responsible for the independent acts, omissions, or service interruptions of third-party providers, except to the extent required by law.
All intellectual property rights in Tipu by 4E's™, including its software, platform functionality, design, structure, text, graphics, logos, trademarks, documentation, and related materials, are owned by or licensed to Tipu by 4E's™ and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms of Use or by law, no part of Tipu by 4E's™ may be copied, reproduced, adapted, modified, distributed, republished, reverse engineered, decompiled, or otherwise exploited without Tipu by 4E's™’s prior written consent.
Tipu by 4E's™ requires its employees and personnel to comply with their contractual obligations and with all lawful and reasonable workplace policies, standards, and procedures, including those relating to confidentiality, privacy, information security, acceptable use of systems, and professional conduct.
Tipu by 4E's™ may modify, update, suspend, or discontinue any part of the platform from time to time, including features, functionality, integrations, authentication settings, or security requirements. While Tipu by 4E's™ will use reasonable efforts to maintain service availability, it does not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, Tipu by 4E's™ provides the platform on an "as is" and "as available" basis. Tipu by 4E's™ does not warrant that the platform will be uninterrupted, error-free, fully secure, or suitable for every user purpose. Nothing in these Terms of Use excludes or limits any right or remedy that cannot lawfully be excluded or limited under applicable law.
To the maximum extent permitted by law, Tipu by 4E's™ will not be liable for any indirect, consequential, incidental, special, or exemplary loss, damage, cost, or expense, including loss of profits, revenue, goodwill, data, or business opportunity, arising out of or in connection with the use of, or inability to use, Tipu by 4E's™. To the extent permitted by law, Tipu by 4E's™’s total liability for any claim arising out of or in connection with these Terms of Use or the platform will be limited to the amount paid by the relevant customer to Tipu by 4E's™ for the use of Tipu by 4E's™ in the 12 months preceding the event giving rise to the claim, or NZD 100 if no fee was paid.
Tipu by 4E's™ may suspend or terminate access to the platform, in whole or in part, immediately if it reasonably considers that you have breached these Terms of Use, created a security risk, acted unlawfully, or otherwise exposed Tipu by 4E's™ or any other person to risk or harm. Upon termination, rights granted to you under these Terms of Use cease immediately, except for provisions intended to survive termination.
16. Governing law These Terms of Use are governed by the laws of New Zealand. The courts of New Zealand will have non-exclusive jurisdiction in relation to any dispute arising out of or in connection with these Terms of Use or the use of Tipu by 4E's™.
Tipu by 4E's™ may amend these Terms of Use from time to time by publishing updated terms on the platform or otherwise notifying users. Continued use of Tipu by 4E's™ after the updated terms take effect constitutes acceptance of the amended terms.
